Terms of use
In plain English. Use Escape Velocity as a tracker. You are responsible for the numbers you put in and the decisions you make.
1. Agreement
These terms apply when you use the Escape Velocity website or web app, provided by Market Titans Group Pty Ltd (ABN 82 642 540 734, ACN 642 540 734). By using them you agree to these terms. You must be 18 or older. In the app you agree by ticking the box on the important information page, and you tick it again when we change that page in a way that matters. The important information page in the app is the agreement for using the app. These terms say the same things in a longer form.
2. What the service is
Escape Velocity is an online net worth and financial-independence tracker. It is a virtual playground: a place to try numbers and see what happens. The numbers you enter may or may not be real, we do not check them, and we cannot tell. It does arithmetic on those numbers and on the assumptions shown, and shows what-ifs. It does not connect to your bank accounts or fetch live prices.
3. Not advice, and not a fiscal tool
Everything in Escape Velocity is general information and general calculation. It is not personal advice and does not take into account your objectives, financial situation or needs. It is not financial product, investment, credit, tax, legal, accounting, superannuation or insurance advice, and it is not a recommendation about whether to buy, hold or sell anything. We are not financial advisers and we do not hold an Australian financial services licence. See General information, not advice.
It is also not a fiscal tool. Do not use it for a tax return, accounts, bookkeeping, a loan or credit application, a legal document or any other official purpose. Goals, dates and forecasts are estimates, not predictions or promises. Real results will differ, and you may lose money. Speak to a licensed professional before you act on anything.
4. Your account and your responsibilities
- You are responsible for the accuracy of the numbers you enter and for any decisions you make using the app.
- A number can be wrong, out of date, mistyped or lost, and everything built on it is then wrong too. The calculations and the software may also contain errors.
- Your numbers are saved to your account. Saving copies mistakes too, so keep a backup file of your own and your official statements. Escape Velocity is not a secure place to keep your records. Do not store passwords, account numbers, tax file numbers or identity documents in it.
- If you create an account, give us an email address you control, and keep the log-in links we send it to yourself. You can delete the account at any time from the Account page.
5. Changes to features
Features may change, be unavailable, or be removed. Email depends on our email provider and may be unavailable.
6. Acceptable use
Do not misuse Escape Velocity. Do not attack, overload or probe it, including the account and email services. Do not use it unlawfully. Do not try to get into anyone else’s account or data. Do not use it to send email to people who have not asked for it. Do not copy it, resell it or take it apart to build a competing service.
7. Ownership, your numbers and other people’s services
The app, the website, their design and their code belong to us or to our licensors. We give you a personal, non-exclusive, non-transferable licence to use them for your own purposes while these terms allow it.
The numbers you enter stay yours. You give us permission to store and process them so that Escape Velocity can work for you, and to make anonymous totals if you choose to share figures with other members. If you send us feedback, we may use it to improve Escape Velocity without owing you anything.
Escape Velocity links to or works with services we do not run, such as calendar apps, email and video sites. The Die with zero intro video is third-party content hosted by YouTube. We do not control these services and we are not responsible for them. Figures shown from other members are made from numbers that members choose to share anonymously. We do not check them, and they are not a benchmark, a ranking or advice.
Donating is optional and unlocks nothing. Card payments are taken by Stripe, and its own terms apply to the payment. Donations are not tax deductible, because Escape Velocity is run by a company, not a charity.
8. Availability, warranties and liability
Escape Velocity is provided as it is and as available. To the maximum extent the law allows, we give no warranty or promise of any kind about it, including that it is accurate, complete, current, reliable, secure, free of errors, suitable for your purpose or always available. We may change, suspend or withdraw any part of it at any time. You use it at your own risk and you are responsible for every decision you make.
To the maximum extent the law allows, we and our owners, directors, employees, contractors and suppliers are not liable to you or to anyone else for any loss or damage of any kind that arises out of or in connection with Escape Velocity, these terms or anything you read or do because of it. That covers direct, indirect, special and consequential loss, lost savings, lost profit or opportunity, investment and trading losses, tax, fines and penalties, lost or corrupted data, and loss from relying on any number, forecast or review. It applies whether the claim is in contract, in negligence or another tort, under statute or otherwise.
Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy, or any guarantee, warranty or term, that the law gives you and that cannot lawfully be excluded, including under the Australian Consumer Law. Where the law allows us to limit our liability for breaking one of them, our liability is limited to supplying the service again or paying the cost of having it supplied again.
9. Ending your account
You can stop using Escape Velocity and delete your account at any time from the Account page. Deleting it removes your email address, your numbers, your logins, your reminder and what was stored for your milestone emails and monthly update, as the privacy policy describes. Back up anything you want to keep first, because we cannot bring it back. We may suspend or end your access if you break these terms or misuse the service, or to protect the service or other people. The parts of these terms that are meant to continue, such as the limits on our liability and the governing law, continue after your access ends.
10. Changes and governing law
We may update these terms and Escape Velocity. We will change the date at the bottom of this page. If a change matters, we will ask you to read and accept the new version again in the app. If you carry on using Escape Velocity after that, you accept the new version. If any part of these terms cannot be enforced, the rest still applies.
These terms are governed by the laws of South Australia, Australia, and you and we submit to the courts of that State.
